Part 1


Gihan 


It rained last night!

Gihan felt tired when he woke up in the morning. Maybe he didn’t sleep well or too much was going in his head. It’s just another day in court he thought…he was trying to console himself. He been practicing law for almost 25 years now, yet every time he goes to trial, he feel nervous. Sometimes he wonders how his colleagues look so calm on the bench. Maybe he takes his job too seriously and want to do justice to the letter. His law office is located few blocks away from his home in Kelaniya. It means he didn’t have to go join the morning driving frenzy towards Colombo every day. It was 8.30am when he walked in-to the office and it was already bustling with staff.

Shanika, anyone called me?

No sir..there is lady in the reception. I think she has some domestic issues.

Okay..tell her that I will see her in 30 minutes. Did you prepare my trial documents for today?

Yes sir, it is almost done. Sir your session is at 1.30pm.

Okay Shanika..with that he started reading documents he needed for the trial session.

That is when Shanika came to him.. ‘ Sir, there is a call from’

From whom?

Shanika started smiling..an uneasy smile that is.

Right away Gihan knew who is at the other end...Can you transfer the line to my office room?

He closed the office door and took the line.   

‘Sir this is Rani.. we got into trouble again’

Oh Rani..at least they keep their names simple and easy to remember.

‘Where are you now and how many of you got arrested this time?’

‘me and another 02 girls..Sergeant sir said we are going to courts at 11am..please sir, can you help us’

‘Rani I dont remember how many times I have appeared for you..and you know what I also don’t remember the last time you paid for my service’
She didn’t say anything for a little while..but he felt her anguish over the phone..after a long breath she spoke;

‘We don’t have anyone to call..I need to feed my kids and send them to school so they don’t end up like me in the street..there is no one to look after them if I go to jail ..please help me sir’

He heard that story before.. 

‘Who is the Sergeant who picked you from the streets , Karunathilaka or Kodithuwakku?’  

‘Kodithuwakku’ sir.

‘Okay I will be there..but remember this is the last time’

Think he told that last time as well.

She didn’t say anything..but Gihan felt her smile.

Sanka 
 

 
Sanka was walking to the lake to have a bath when he heard Dulmini. She was going to the lake too with her mother.
 
‘Sanka ..ayoo the phone battery you gave me last month died few days ago..can you buy me a good one ‘
 
‘That is actually a good thing..she spend lot of time on this phone..I don’t know what she is up-to’ her mother interrupted.
 
‘When I go to Colombo, I will bring you a good battery. You can just pay me the difference..the ones I find in Anuradhapura town is not that good..but they are cheap so I bring them here. you know I cannot sell the expensive ones in our village.’
 
Sanka was the eldest son of his family. After doing ALs few years ago, he decided to start small communication centre inside his mother’s grocery shop in the village. He started getting a good income from the business and perhaps that might have prevented him from applying to university. Few months ago he started repairing phones and small electronics as a hobby and soon it become a booming business.These days he even gets customers from Anuradhapura main town although he lives in a small village between Anuradhapura and Thalawa.
 
‘Sanka keep next Friday free..remember it’s Poya day’ Dulmini
 
Every Poya day Sanka joins Dulmini and her mother to bring lotus flowers to Anuradhapura. He has been doing this since Dulmini’s father died five years ago.In a small village like this, people help each other without expecting much in return.Maybe she was afraid that Sanka might forget to join them since he is busy now.
 
When they reached the lake, it was a beautiful evening..the sun was just about to go down and the lake look like it is filled with golden liquid. The gentle wind that fan across the lake created golden ripples. Not many people were there at the bathing spot. In the village people go to bed early after working in the fields. 
 
Dulmini and her mother started changing cloths while Sanka jumped to the water from the bank. He likes doing this even as a kid.He heard someone else also jumped from above.It is Thisara.
 
‘Hello Thisa I didn’t see you were coming..were you stalking us’
 
‘Naa..I saw you two and having a nice cozy chat..so I didn’t want to bother you’
 
‘Really..you must have spent too much time under midday-sun that and something is gone wrong inside you’ Sanka was smiling.
 
‘well unlike you.. I am not smart enough to do desk jobs and make money..I have to work in the field’
 
‘oh common Thisa..i was just kidding..i didn’t mean anything like that’
 
‘I know you didn’t Sanka’ Thisara touched his shoulder.
 
Thisara body is carved like a model, Sanka thought. It seems like working in field has its benefits. From one side Sanka could see Dulmini’s wet clothes sticking to her body and making it almost transparent. On the other side, he could see Thisara’s toned legs and chest. He couldn't decide which one to look for.
 
Sanka took a long breath and went under the water….

Gihan


Gihan is one of the best trial lawyers in the country and one of the richest too. He is well known personality among Colombo’s elite and frequently appears on legal aid programs on TV.  Although most people cannot afford his legal
service, occasionally Gihan provides his service at low or no cost when he thinks it is important to do so. 


Today is one of those days;


While walking towards the court room, he was thinking who the judge going to be..specifically whether it is going to
be a male or female judge. Having a female judge will make his job much easier. They tend to take a compassionate 
view on the plight of sex workers, work on the street.  


When he reached the court-room he saw the girls been escorted towards the custody room inside the courthouse. 
There is not lot of formal procedures to follow in lower courts where most of the petty crimes cases are heard.


When they are behind the bars, he approached the officer in charge – Sergeant Kodithuwakku.


‘Sergeant I am appearing for the girls..would you mind if I have a word with my client? ‘


He has met Sergeant Kodithuwakku several times at the same place for the same reason. Over a time Gihan 
got to know Kodithuwakku as a good officer and respected him.  


‘go ahead’ sergeant replied.


‘When you were in custody, did someone physically or otherwise abused you? ’ Gihan asked the girls   


‘No sir, they took us straight to the police station and logged our names and address in the register..then we were 
taken to the custody room and left alone..’


‘That sounds good’


The court session started;


‘All rise’ the court administrator screamed when judge came in the court room. It was a female judge.


After several other cases were heard, case no 12-B was called.


‘The defendants were accused of selling sexual services for money’ the court administrator read out charges.


‘Are you pleading guilty or not guilty’ asked the judge.


‘Not guilty my lord Rani said in broken voice and other 2 girls followed’


‘Let’s proceed then..does the defendant have legal representation’ court admin.


‘Yes, I am Gihan Amarasooriya legal counsel for the defendant’


The court suddenly filled with a buzz..Its not usual to see a high profile lawyer like Gihan appearing in lower 
court defending pretty crimes.


‘who represents the state?’ court admin


‘Sergeant  Kodithuwakku – batch no 89443’


‘Proceed the case’ court admin


‘My lord, we found the 3 defendants on main street at 12.30 midnight yesterday trying to entice a few men..we
observed their actions for a about an hour and came to the conclusion that they are in the process of selling sex. 
also the defendants were known in the area to engage in such activities’ sergeant Kodithuwakku


‘My lord despite the observation made by the police, no money was accepted by my client. It seems in this situation
the police over-reacted based on speculation’ Gihan


‘My Lord, we have undercover agents who are willing to testify that the defendants were actually prepared to 
accept money in exchange of sex’ sergeant
 
‘My lord, that is entrapment..you cannot entice someone to commit a crime and later accuse them of doing so..
maybe your undercover agents had something else in their mind’ Gihan


With that whole court-room burst into laughter.


It seems like suddenly sergeant Kodithuwakku was running out of ideas.


‘My lord everyone knows defendants are in the business of selling sex..and what else 3 girls doing in the
street at 12.30 midnight’ sergeant concluded.


Finally judge spoke;


‘sergeant Kodithuwakku.. in future do not bring anyone into my court unless you have a good evidence..when
I say good evidence, that does not mean hearsay or speculation. Based on the evidence produced today, 
I don’t see any reason to hold the defendant in the custody furthermore. You are free to go now’


With that court took a recess.  


The girls thanked Gihan and left. Gihan found Sergeant Kodithuwakku sweating under a tree.


‘Sergeant can I have a word with you?’


He nodded with approval.


‘Why do you go after these girls where there are enough criminals roaming in the city?’


‘this was not my idea at all..our OIC wanted us to do this..I know what he wanted’


‘What do you think he want? ‘Gihan was curious.


‘Never mind..I have to go now. Have a good day Mr. Amarasooriya’


‘Have a good day sergeant’



The rest of Gihan’s day was cramped with work but somehow he felt good when we went to bed that night.

I am not a frequent visitor because this place is dead with minimum activity most of the times. 

But I will be here daily for your story just like for your last one should you keep writing. ''One I remember'' was beautiful and the ending was poignant.

I can see where things could be going with Jehan's Anuradhapura visit *wink wink*
